ShortForm shall not be liable to any user for any damages that might arise from use or inability to use the website, or from the activities of any other user. By using this website, you release ShortForm, its officers, employees, agents and successors from any and all claims for damages related to this website or interaction with other users.
Premium Channels
Billing
The fees for your Premium Channels will be billed 30 days after the date you convert to and automatically renewed monthly until you cancel it. You can see the billing date above your channel. ShortForm will automatically bill your credit card each month on the calendar day corresponding to the commencement of your Premium Channel. ShortForm will bill your account on the first day of the next payment period.
ShortForm may change the fees and charges in effect, or add new fees and charges from time to time, but we will give you advance notice of these charges by email. If you want to use a different credit card or if there is a change in your credit card validity or expiration date, you may edit your information by accessing your “Profile” page. If your credit card reaches its expiration date, your continued use of ShortForm constitutes your authorization for us to continue billing that credit card and you remain responsible for any uncollected amounts. It is your responsibility to keep your contact information and payment information current and updated.
Canceling Your Premium Channel
Your ShortForm Premium Channel will continue in effect unless and until you cancel your Premium Channel or we terminate it. You must cancel your Premium Channel before it renews each month in order to avoid billing of the next month’s fees to your credit card.
ShortForm Premium Channels are prepaid and are non-refundable. SHORTFORM DOES NOT PROVIDE REFUNDS OR CREDITS FOR ANT PARTIAL MONTHS. You may cancel your ShortForm Premium Channel at any time, and cancellation will be effective immediately. If you wish to cancel your Premium Channel you may do so via your “My Channel” page. Should you elect to cancel your Premium Channel, please note that you will not be issued a refund for the most recently (or any previously) charged monthly fees.
By signing up for a ShortForm Premium Channel and providing ShortForm with your payment account information, you hereby agree to these payment terms and conditions.
Free Channels
ShortForm allows you to create as many channels as you want and play those channels on the shortform.com website.
Widget
By embedding a ShortForm widget in your website, you agree to these terms.
Use and Display of ShortForm Embeddable Widgets
In connection with your use and display of ShortForm embeddable widgets, you agree not to:
(a) remove, obscure, alter, or make invisible, illegible, or indecipherable to visitors of your site, any links, trademarks or logos included in the widgets.
(b) modify, redirect, suppress, or substitute the operation of any button, link, or feature of the widgets.
Term and Termination
These terms take effect when you embed a ShortForm widget in your site. You may terminate this agreement at any time by removing all embedded widgets. ShortForm may terminate this agreement at any time by ceasing to serve widgets to your site, or otherwise ceasing to make widgets available to you.
Modification
ShortForm may modify these terms at any time by posting a change notice or a revised agreement on our site. By continuing to use an embedded widget, you agree to the revised terms.
Relationship of Parties
Nothing in this Agreement creates any partnership, joint venture, agency, or employment relationship between you and ShortForm.
Limitation of Liability
In no event shall ShortForm be liable for any damages (including, without limitation, lost profits, business interruption, or lost information) arising from use of, or inability to use, the widgets, even if ShortForm has been advised of the possibility of such damages. In no event will ShortForm be liable for loss of data or for indirect, special, incidental, consequential (including lost profit), or other damages based in contract, tort or otherwise. ShortForm shall have no liability with respect to the content of the embeddable widgets or any part thereof, including but not limited to errors or omissions contained therein, libel, infringements of rights of publicity, privacy, trademark rights, business interruption, personal injury, loss of privacy, moral rights or the disclosure of confidential information.
No Warranties or Representations
ShortForm provides the embeddable widgets “as is.”
ShortForm expressly disclaims any and all warranties for the embeddable widgets including, but not limited to, implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, non-infringement, quiet enjoyment, and warranties arising out of any course of dealing, performance or trade usage.
ShortForm makes no warranty or representation with respect to the accuracy or completeness of any content within the embeddable widgets.
ShortForm may discontinue offering the embeddable widgets, or may change their nature and functionality, at any time. ShortForm makes no representation that the embeddable widgets will continue to be provided, or will function as described consistently or without errors.
ShortForm makes no warranties or representations respecting harm caused by errors or interruptions, nor will it be responsible for unauthorized access or activity to the embeddable widgets or to your site.
Disputes
Any dispute relating to these terms will be adjudicated in any state or federal court in Santa Clara County, California. You consent to exclusive jurisdiction and venue in such courts. The laws of the State of California, without regard to principles of conflicts of laws, will govern any dispute.
