What happened to veteran Herbert Richardson when he was in prison?<\/p>\n\n\n\n<p>The U.S. Justice System fails to recognize veterans who are dealing with trauma and have difficulty readjusting to life after war. <em>Just Mercy<\/em> by <a href=\"https:\/\/www.shortform.com\/blog\/who-is-bryan-stevenson\/\">Bryan Stevenson<\/a> uses the example of Herbert Richardson to show how PTSD is disregarded in trials.<\/p>\n\n\n\n<p>Keep reading to learn more about the unfair treatment of incarcerated veterans with PTSD.<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-extreme-punishments-of-veterans\"><strong>Extreme Punishments of Veterans<\/strong><\/h2>\n\n\n\n<p>Stevenson argues that <strong>the U.S. Justice System disproportionately imprisons traumatized veterans<\/strong>, who can\u2019t smoothly return to society after their service has scarred them.&nbsp;<\/p>\n\n\n\n<p>For example, Stevenson notes that 20% of the incarcerated population in the 1980s had served time in the military. This disproportionate rate, he suggests, was the result of the <a href=\"https:\/\/www.shortform.com\/blog\/tim-obrien-vietnam\/\">Vietnam War<\/a>: Soldiers that brought home war trauma were most likely to end up incarcerated. Consequently, though Stevenson concedes that the rate dropped in the \u201890s, he notes it has started to increase as a result of war in Afghanistan and Iraq.<\/p>\n\n\n\n<p>(Shortform note: Thus far, Stevenson\u2019s suggestion that the rate of incarcerated veterans with PTSD could start to increase hasn\u2019t panned out: In 2012, <a href=\"https:\/\/bjs.ojp.gov\/content\/pub\/pdf\/vpj1112.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">veterans accounted for 6.2% of the U.S.\u2019s prison population<\/a>, whereas in 2018 <a href=\"https:\/\/bjs.ojp.gov\/sites\/g\/files\/xyckuh236\/files\/media\/document\/fpscfsa22.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">that rate dropped slightly to 6.0%<\/a>, followed by a low of 5.6% in 2021. So, it seems the percentage of incarcerated veterans has actually dropped in the most recent decade. Experts credit this decrease in part to <a href=\"https:\/\/www.npr.org\/sections\/thetwo-way\/2015\/12\/07\/458501774\/defying-stereotypes-number-of-incarcerated-veterans-in-u-s-drops\" target=\"_blank\" rel=\"noreferrer noopener\">services such as \u201cveterans courts,\u201d<\/a> which offer veterans psychological treatment instead of jail time for some offenses.)<\/p>\n\n\n\n<p>To demonstrate the system\u2019s failure toward veterans, Stevenson recounts the story of Herbert Richardson, a traumatized Vietnam War veteran. Suffering from severe post-traumatic stress disorder (PTSD), Richardson began dating a nurse in Alabama and grew obsessed with her. However, she recognized his obsession and tried to sever the relationship.&nbsp;<\/p>\n\n\n\n<p>Richardson\u2019s reasoning, Stevenson writes, became faulty and deluded. Consequently, he built a small bomb to detonate on his ex-girlfriend\u2019s porch, planning to win her affection by rescuing her after the explosion. However, his ex-girlfriend\u2019s niece found the bomb first and decided to shake it; she was killed instantly by the explosion.<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table><tbody><tr><td><strong>How Trauma Harms Veterans\u2019 Ability to Form Relationships<\/strong><br><br>In <a href=\"https:\/\/shortform.com\/app\/book\/the-body-keeps-the-score\" target=\"_blank\" rel=\"noreferrer noopener\"><em>The Body Keeps the Score<\/em><\/a>, Bessel van der Kolk explores the <a href=\"https:\/\/www.shortform.com\/blog\/long-lasting-effects-of-childhood-trauma\/\">lasting effects of trauma<\/a> on survivors\u2019 bodies and brains. With respect to veterans in particular, he argues that <a href=\"https:\/\/www.shortform.com\/app\/book\/the-body-keeps-the-score\/chapter-1#identifying-trauma-in-war-veterans\" target=\"_blank\" rel=\"noreferrer noopener\">they constantly replay traumatizing wartime episodes<\/a>\u2014such as bomb detonations, gunfire, and friends\u2019 deaths\u2014which perpetuates the cycle of trauma. Because these flashbacks can occur at any time, van der Kolk notes <a href=\"https:\/\/www.shortform.com\/app\/book\/the-body-keeps-the-score\/chapter-2#flashbacks-alter-perception\" target=\"_blank\" rel=\"noreferrer noopener\">that they can be more harmful than the original event<\/a>, which at least had a definitive end.<br><br>To avoid these painful flashbacks, <a href=\"https:\/\/www.shortform.com\/app\/book\/the-body-keeps-the-score\/chapter-2#emotional-numbness-and-fixation\" target=\"_blank\" rel=\"noreferrer noopener\">veterans often fixate on some distraction<\/a>, whether it\u2019s the gym, drugs, or\u2014in Richardson\u2019s case\u2014a romantic partner. However, because traumatized veterans have experienced severe harm from other humans, <a href=\"https:\/\/www.shortform.com\/app\/book\/the-body-keeps-the-score\/chapter-2#isolation-and-shame\" target=\"_blank\" rel=\"noreferrer noopener\">their capacity for trust and intimate connection is hindered<\/a>. Consequently, veterans can experience deep-seated feelings of isolation, leading them to act dangerously; in Richardson\u2019s case, this trauma-induced isolation may have fueled his obsession with his ex-girlfriend.<br><br>Additionally, experts argue that veterans are often hesitant to seek treatment for PTSD because of <a href=\"https:\/\/www.jstor.org\/stable\/10.7249\/mg720ccf\" target=\"_blank\" rel=\"noreferrer noopener\">stigma against mental illness that\u2019s especially prevalent in the military<\/a>. Nonetheless, others note that <a href=\"https:\/\/www.ncbi.nlm.nih.gov\/pmc\/articles\/PMC5047000\/\" target=\"_blank\" rel=\"noreferrer noopener\">cognitive behavioral therapy (CBT) has proven effective in treating PTSD<\/a> among combat veterans, and the US Department of Veterans Affairs (VA) provides <a href=\"https:\/\/www.va.gov\/health-care\/health-needs-conditions\/mental-health\/ptsd\/#:~:text=This%20includes%20proven%20methods%20like,ve%20been%20through%20similar%20traumas\" target=\"_blank\" rel=\"noreferrer noopener\">an array of treatment options for traumatized veterans<\/a>.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p>At trial, the prosecution argued that Richardson was evil, rather than recognizing that trauma had made him mentally unstable. Further, Stevenson mentions that the prosecution claimed Richardson had <em>intended<\/em> to kill, making the crime punishable with the death penalty.&nbsp;<\/p>\n\n\n\n<p>Meanwhile, because Alabama law only paid public defenders $1,000 for preparation time, Richardson\u2019s counsel\u2014who was later disbarred\u2014didn\u2019t research any mitigating factors, like his military tenure and lasting trauma. So, after a one-day trial, the judge sentenced Richardson to death. Despite Stevenson\u2019s best efforts to get a stay of execution, the sentence was carried out: <strong>Richardson was executed via electric chair in August of 1989<\/strong>. As he walked to his death, the prison played the hymn, \u201cThe Old Rugged Cross,\u201d per his final request.<\/p>\n\n\n\n<p>(Shortform note: Although executions via electric chair have become less common, with some<a href=\"https:\/\/www.nytimes.com\/2008\/02\/08\/us\/08cnd-penalty.html\" target=\"_blank\" rel=\"noreferrer noopener\"> state supreme courts deeming it cruel and unusual punishment<\/a>, it remains an <a href=\"https:\/\/deathpenaltyinfo.org\/executions\/methods-of-execution\" target=\"_blank\" rel=\"noreferrer noopener\">option for prisoners to request in eight states<\/a>.
