If the Supreme Court rules that Section 230 doesn\u2019t apply to social media companies, they will likely block all controversial content to limit their liability.<\/p>\n\n\n\n<p>Read on to learn about Section 230 and how these changes may transform social media as we know it.<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-section-230-social-media-explained\">Section 230 &amp; Social Media Explained<\/h2>\n\n\n\n<p>This year, SCOTUS will likely rule on three cases that could reshape social media as we know it, or dictate what shapes it <em>can<\/em> take by clarifying the boundaries of social media companies\u2019 legal immunity and powers of suppression.&nbsp;Until now, under U.S. Code Section 230, social media companies have enjoyed legal immunity from the content posted on their platforms by third parties.<\/p>\n\n\n\n<p>In this article, we&#8217;ll explain how Section 230 applies to social media companies, why it&#8217;s being challenged, and how social media companies are responding.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-what-the-laws-currently-say\">What the Laws Currently Say<\/h3>\n\n\n\n<p>The reason that these boundaries are unclear is that they are specified by laws which were written before <a href=\"https:\/\/www.shortform.com\/blog\/the-rise-of-social-media\/\">the rise of social media<\/a>. The court\u2019s rulings will focus on how U.S. Code Section 230 and the First Amendment of the U.S. Constitution apply to social media companies.&nbsp;<\/p>\n\n\n\n<p>Passed in 1791, the First Amendment of the U.S. Constitution <a href=\"https:\/\/constitution.congress.gov\/constitution\/amendment-1\/\" target=\"_blank\" rel=\"noreferrer noopener\">prohibits the government from suppressing free speech,<\/a> including newspapers and other publishers. However,<strong> it doesn\u2019t prevent publishers from being held accountable for what they publish<\/strong>. For example, within certain limits, <a href=\"https:\/\/www.mtsu.edu\/first-amendment\/article\/997\/libel-and-slander\" target=\"_blank\" rel=\"noreferrer noopener\">if a newspaper prints defamatory articles about you, you can sue them<\/a> for libel. And <a href=\"https:\/\/www.mtsu.edu\/first-amendment\/article\/970\/incitement-to-imminent-lawless-action\" target=\"_blank\" rel=\"noreferrer noopener\">a publisher who calls for riots acts of terror could be charged with incitement<\/a>.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.theverge.com\/21273768\/section-230-explained-internet-speech-law-definition-guide-free-moderation\" target=\"_blank\" rel=\"noreferrer noopener\">Passed in 1996 as the Communications Decency Act<\/a>, Section 230 of the U.S. Code <a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/USCODE-2021-title47\/pdf\/USCODE-2021-title47-chap5-subchapII-partI-sec230.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">encourages companies that provide access to information via the internet to voluntarily restrict violent, obscene, or otherwise objectionable content<\/a>. It does this mostly by establishing that <strong>they cannot be held liable for content that people post on their platforms<\/strong> because they are not the ones publishing or \u201cspeaking\u201d the content. Instead, the person who creates or uploads content is solely responsible for what she says online\u2014even when platforms actively filter what their users post.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-challenging-the-scope-of-section-230\">Challenging the Scope of Section 230<\/h3>\n\n\n\n<p>This month, SCOTUS will likely hear <em>Gonzalez vs Google<\/em>, which challenges the blanket immunity from liability that social media companies have enjoyed under Section 230.&nbsp;<\/p>\n\n\n\n<p>The <a href=\"https:\/\/abcnews.go.com\/Politics\/family-american-terror-victim-asks-supreme-court-curb\/story?id=96463560\" target=\"_blank\" rel=\"noreferrer noopener\">Gonzalez family sued Google over the death of their daughter Nohemi in a terrorist attack that was allegedly incited by a YouTube video<\/a>. They argue that Section 230 shouldn\u2019t apply in this case, and Google (which operates YouTube) should be held accountable when content on their platform contributes to terrorist attacks.<\/p>\n\n\n\n<p>The U.S. Justice Department filed a brief in support of Gonzalez, saying that social media companies like YouTube shouldn\u2019t qualify for <a href=\"https:\/\/www.washingtonpost.com\/politics\/2022\/12\/09\/tech-critics-urge-supreme-court-narrow-section-230\/\" target=\"_blank\" rel=\"noreferrer noopener\">Section 230 immunity because they go beyond just removing objectionable content, and use their algorithms to promote content for users.<\/a> Promoting the content should make them accountable for it, especially in cases like this where their algorithms appear to have amplified the terrorists\u2019 message.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-what-are-social-media-companies-saying\">What Are Social Media Companies Saying?<\/h3>\n\n\n\n<p>A number of social media companies, including Meta (Facebook), Microsoft (which runs LinkedIn), and Twitter filed briefs in support of Google, saying that a narrower definition of immunity under Section 230 would not only undermine their business model, but also hinder public discussion of relevant issues, especially controversial issues.<\/p>\n\n\n\n<p>They argue that their content recommendation algorithms are essential because they make the vast amount of information stored on their platforms accessible: <a href=\"https:\/\/news.bloomberglaw.com\/us-law-week\/microsoft-backs-google-in-section-230-supreme-court-case\" target=\"_blank\" rel=\"noreferrer noopener\">Without algorithms to selectively promote content to individual users, nobody would be able to find what they\u2019re looking for on social media<\/a> sites. And without user engagement, the platforms would die. But if social media companies become liable for what their users post, <a href=\"https:\/\/abcnews.go.com\/Politics\/family-american-terror-victim-asks-supreme-court-curb\/story?id=96463560\" target=\"_blank\" rel=\"noreferrer noopener\">they would likely remove all content that\u2019s even remotely controversial to protect themselves from liability<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>What is Section 230 in terms of social media companies?
