To stop the Supreme Court from overstepping its power, many are pushing for a Supreme Court reform.<\/p>\n\n\n\n<p>Here\u2019s a look at the most common arguments for reforming the Supreme Court, and the strategies that could be used to carry it out.<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-reforming-the-u-s-supreme-court\"><strong>Reforming the U.S. Supreme Court<\/strong><\/h2>\n\n\n\n<p>In the wake of the Supreme Court\u2019s decision overturning Roe v. Wade, many people are <a href=\"https:\/\/www.newsweek.com\/can-democrats-expand-supreme-court-how-likely-it-1720256\">calling for reform<\/a> to counter what they view as <a href=\"https:\/\/fivethirtyeight.com\/features\/the-supreme-courts-partisan-divide-hasnt-been-this-sharp-in-generations\/\">the court\u2019s increasingly partisan bent<\/a>. They feel the court\u2019s recent rulings on abortion, gun control, and voting rights, and its hints that it might want to <a href=\"https:\/\/www.nbcnews.com\/politics\/supreme-court\/thomas-wants-supreme-court-overturn-landmark-rulings-legalized-contrac-rcna35228\">overturn established rulings on contraception and same-sex marriage<\/a>, show that it\u2019s overstepped its mandate, <a href=\"https:\/\/www.nytimes.com\/2022\/06\/29\/opinion\/supreme-court-legitimacy-crisis.html\">is no longer a non-partisan body<\/a>, and needs to be brought back into alignment with the wishes of the majority of Americans.&nbsp;<\/p>\n\n\n\n<p>In this article, we\u2019ll take a look at the cases for the reform of the Supreme Court.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-the-case-for-reform\"><strong>The Case for Reform<\/strong><\/h3>\n\n\n\n<p>The leading argument for reform holds that the Court\u2019s decisions have grown out of step with the desires of the majority of Americans, and thus the Court no longer fulfills the role the Founding Fathers intended for it.&nbsp;<\/p>\n\n\n\n<p>Proponents of reform acknowledge that the Founding Fathers designed the Court to withstand public pressure\u2014for example, the lifetime tenure provision was intended to protect Justices from administrations that may not agree with them\u2014but they contend that <strong>the Court has become <\/strong><strong><em>so<\/em><\/strong><strong> out of step with public wishes that it\u2019s become an actively anti-democratic body, regularly upholding laws that run counter to the will of the majority.<\/strong> Therefore, instead of functioning as a <em>check<\/em> on political trends, it\u2019s become a political influencer itself, which is inherently at odds with the intentions of the Founding Fathers.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<p>Advocates for reform note that <a href=\"https:\/\/www.theguardian.com\/commentisfree\/2022\/jun\/27\/us-supreme-court-abortion-roe-v-wade-justices-expansion\">five of the six conservative Justices on the current Court<\/a>\u2014the majority of the Court\u2014were appointed by presidents who lost the popular vote (George W. Bush and Donald Trump) and were confirmed by a Senate that more heavily weights the desires of states with smaller populations (currently, the Senate is split evenly in half, but <a href=\"https:\/\/www.npr.org\/2021\/06\/09\/1002593823\/how-democratic-is-american-democracy-key-pillars-face-stress-tests\">Democrats represent 185 million voters while Republicans represent 143 million voters<\/a>).&nbsp;<\/p>\n\n\n\n<p>They argue that the minority rule in this dynamic contradicts the Founders\u2019 democratic ideals. They also note another danger: It can tempt the Court to \u201cplace their thumb on the scale\u201d and uphold laws that could help a minority party cling to power\u2014for example, by ruling in favor of highly manipulated and gerrymandered voting districts.&nbsp;<\/p>\n\n\n\n<p>Reform advocates further note that a Court that appears to be politically motivated has less legitimacy in the public\u2019s eye. The danger, should the public grow to view the Court as illegitimate, is that people might, en masse, <a href=\"https:\/\/www.wweek.com\/news\/2022\/06\/29\/what-happens-if-americans-stop-recognizing-the-legitimacy-of-the-supreme-court-we-asked-a-constitutional-scholar\/\">purposefully stop adhering to its rulings<\/a>. Such a change would gravely test the country\u2019s legal system.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-proposals-for-reform\"><strong>Proposals for Reform<\/strong><\/h3>\n\n\n\n<p>Beyond the debate over whether the Court <em>should<\/em> be reformed, there\u2019s debate on <em>how<\/em> it might be reformed. Advocates for reform typically propose one of three strategies:&nbsp;<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>Expanding the Court<\/li><li>Establishing term limits<\/li><li>Regularizing appointments<\/li><\/ol>\n\n\n\n<p>We\u2019ll explore the discussions around each approach below.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-the-case-for-expanding-the-court\"><strong>The Case for Expanding the Court<\/strong><\/h4>\n\n\n\n<p>The first approach to reforming the Supreme Court, and one that\u2019s received much attention lately, is <strong>increasing the number of Justices <\/strong>(often referred to as \u201cpacking\u201d the Court). Many advocates of this reform want the Biden administration to immediately add four seats to the Court, raising the total from nine to 13 and turning the current six-member Republican-appointed majority into a 6-7 minority.&nbsp;<\/p>\n\n\n\n<p>Proponents of this approach say it will <a href=\"https:\/\/demandjustice.org\/expandthecourt\/\">immediately fix the political imbalance of the Court<\/a> and that it would be a justifiable intervention given how wildly the Court differs from the electorate on many issues. They argue that the current partisanship is so entrenched that it can only be fixed through dramatic, systemic change, and without this kind of move, the country will remain under minority rule for the next few generations at least.<\/p>\n\n\n\n<p>They note, further, that the move would be both legal and with precedent: The Constitution <a href=\"https:\/\/constitutioncenter.org\/blog\/why-does-the-supreme-court-have-nine-justices\">doesn\u2019t specify how many Justices should sit on the Court<\/a>, and over the years, Congressional law has set the number at six, nine, five, seven, and 10, before President Ulysses S. Grant settled on <em>nine<\/em> for a final time in 1869 (for unclear reasons).&nbsp;&nbsp;<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-the-case-for-term-limits\"><strong>The Case for Term Limits&nbsp;<\/strong><\/h4>\n\n\n\n<p>Another approach would be to <strong>limit the length of time each Justice serves.<\/strong> The Supreme Court <a href=\"https:\/\/www.whitehouse.gov\/wp-content\/uploads\/2021\/10\/TERM-LIMITS.pdf\">is almost unique among courts<\/a>, both domestically and globally, in appointing judges to life tenures. Among U.S. state courts, only Rhode Island doesn\u2019t impose either term limits or a mandatory retirement age on its judges, and among major constitutional democracies, the U.S. is the only one that doesn\u2019t do the same.&nbsp;<\/p>\n\n\n\n<p>Advocates of term limits (most of whom recommend 18-year terms) argue that limiting the time Justices serve would make Supreme Court appointments less of a political prize: It would <a href=\"https:\/\/www.nytimes.com\/2021\/12\/31\/opinion\/supreme-court-term-limits.html\"><strong>reduce the incentive for presidents to appoint young, ideological Justices<\/strong><\/a> who could stay on the court for decades and drive it in a predetermined political direction. This would help to decouple the Court from elections, making it more independent.&nbsp;<\/p>\n\n\n\n<p>Proponents say that term limits would also prevent the political maneuvering that currently accompanies appointments. It would <strong>reduce the <a href=\"https:\/\/www.shortform.com\/blog\/what-is-incentive-meaning-and-definition-economics\/\">incentive<\/a> for a Justice to retire based on political calculations<\/strong> so that a particular president can fill their spot\u2014as illustrated by Democratic pressure on Ruth Bader Ginsburg <a href=\"https:\/\/www.reuters.com\/article\/us-usa-court-ginsburg\/u-s-justice-ginsburg-hits-back-at-liberals-who-want-her-to-retire-idUSKBN0G12V020140801\">to retire during President Obama\u2019s administration<\/a> so he could fill her spot. And it would <strong>preclude either party from delaying or rushing appointments<\/strong> according to how it might benefit them politically\u2014as some accused the Republican party of doing when it <a href=\"https:\/\/www.usatoday.com\/story\/opinion\/2020\/10\/12\/republican-mcconnell-hypocrisy-destroying-supreme-court-column\/5966069002\/\">refused to confirm Merrick Garland, an Obama nominee, during an election year but then fast-tracked the confirmation of Trump nominee Amy Coney Barrett<\/a> during the 2020 election year.&nbsp;<\/p>\n\n\n\n<p>Essentially, advocates say, term limits would make the appointment process fairer. If terms expired in a regular rotation, appointments could be more evenly and predictably spaced among different administrations, ultimately making the Court more politically balanced. Advocates note that term limits wouldn\u2019t necessarily create a <em>bipartisan<\/em> court\u2014if one party wins more elections, it will appoint more Justices. But the system <em>would<\/em> ensure a court that more accurately reflects the wishes of the populace as expressed through elections.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-the-case-for-term-appointments\"><strong>The Case for Term Appointments<\/strong><\/h4>\n\n\n\n<p>A less-frequently discussed idea, but one that has some ardent supporters, focuses not on the <em>retirement<\/em> of Justices but <a href=\"https:\/\/www.politico.com\/news\/magazine\/2022\/01\/15\/supreme-court-reform-justices-527111\">instead on their <em>appointment<\/em><\/a>. In this system, <strong>every administration would get to nominate one Justice<\/strong>, regardless of the current makeup of the court. This means that the number of Justices would fluctuate: It might increase if Justices are added before others retire, but conversely, if Justices retire or die between scheduled appointments, their spot would remain open until after the next election cycle.&nbsp;<\/p>\n\n\n\n<p>According to proponents, this type of system would have the benefits of a term-limit system while avoiding some of its potential problems. It would make the appointment process fairer and more predictable: Many observers note that <a href=\"https:\/\/www.whitehouse.gov\/wp-content\/uploads\/2021\/12\/SCOTUS-Report-Final.pdf\">there\u2019s no justification for the randomness of the current system that might allow one president three or more nominations and another, zero<\/a>. And, because it would allow Justices to serve as long as they wish, it would reduce their incentive to audition for their next job with legal opinions favorable to potential employers.&nbsp;<\/p>\n\n\n\n<p>Further, because appointments would be non-negotiably regular, Justices would have zero incentive to retire early and hand an appointment to a favored administration.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-final-words\"><strong>Final Words<\/strong><\/h2>\n\n\n\n<p>Of the three proposed reforms, the term limits idea has the most traction. It has bipartisan support among legislatures, think tanks, academic experts, and several of the Justices themselves.&nbsp;<\/p>\n\n\n\n<p>Expanding the court has gained a lot of attention <a href=\"https:\/\/demandjustice.org\/priorities\/supreme-court-reform\/\">from advocacy groups<\/a>, but <a href=\"https:\/\/www.wsj.com\/articles\/group-of-democratic-lawmakers-to-present-plan-to-expand-supreme-court-11618447336\">few high-level legislators publicly support the idea<\/a>. Notably, President Biden himself <a href=\"https:\/\/thehill.com\/opinion\/judiciary\/3541613-biden-was-right-expanding-the-supreme-court-is-a-boneheaded-idea\/\">has long opposed it<\/a>.&nbsp;<\/p>\n\n\n\n<p>In 2021, President Biden put together a commission to <a href=\"https:\/\/www.whitehouse.gov\/wp-content\/uploads\/2021\/12\/SCOTUS-Report-Final.pdf\">examine the merits and methods<\/a> of Supreme Court reform. The Commission\u2019s findings were consistent with the above trends: It <a href=\"https:\/\/www.npr.org\/2021\/12\/06\/1061959400\/bidens-supreme-court-commission-releases-draft-report\">didn\u2019t recommend whether or not to expand the court<\/a>, instead limiting its discussion to laying out the pros and cons, but it did come out more strongly <a href=\"https:\/\/www.whitehouse.gov\/wp-content\/uploads\/2021\/10\/TERM-LIMITS.pdf\">in favor of term limits<\/a>.&nbsp;&nbsp;<\/p>\n\n\n\n<p><em>Do you think it\u2019s time for a Supreme Court reform, or do you think it\u2019s doing the job that the Founding Fathers intended?
