Did you know companies do this on purpose?<\/p>\n\n\n\n<p>The global subscription services market is expected to double in size by 2026. Much of its success comes from making it difficult for people to cancel their subscriptions. The US Federal Trade Commission has proposed a \u201cClick to Cancel\u201d rule that would crack down on deceptive company practices.<\/p>\n\n\n\n<p>We&#8217;ll take a look at the Click to Cancel rule below.<\/p>\n\n\n\n<!--more-->\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-what-is-click-to-cancel\">What Is &#8220;Click to Cancel&#8221;?<\/h2>\n\n\n\n<p>Americans spent an average of <a href=\"https:\/\/www.usatoday.com\/story\/money\/2023\/02\/22\/monthy-subscription-fees-tiring-out-consumers\/11313797002\/\" target=\"_blank\" rel=\"noreferrer noopener\">$219 a month<\/a> on subscription-based services in 2022\u2014and not all of them were happy about it. According to one survey, more than 40% of respondents said they had too many subscriptions and more than half wanted to spend less than $50 a month on them.\u00a0<\/p>\n\n\n\n<p>But trying to cancel subscriptions can be like running the ball down the football field and having random players charge off the sidelines and try to block and tackle you\u2014and just as you approach the end zone\u2014if you even make it that far\u2014someone moves the goalposts.\u00a0<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-background\"><strong>Background<\/strong><\/h3>\n\n\n\n<p>Every year the FTC fields <a href=\"https:\/\/www.npr.org\/2023\/03\/23\/1165527249\/ftc-rule-charges-cancel-online-subscriptions\" target=\"_blank\" rel=\"noreferrer noopener\">thousands of complaints<\/a> from consumers who get hit with recurring charges for subscription services they were unable to cancel or didn\u2019t know they signed up for. Experts say that many companies employ a range of strategies to trick customers into buying subscriptions and make terminating services nearly impossible.\u00a0<\/p>\n\n\n\n<p>For example, some use <a href=\"https:\/\/www.vox.com\/recode\/22351108\/dark-patterns-ui-web-design-privacy\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>\u201cdark patterns\u201d<\/strong><\/a><strong>\u2014tactics designed to trick, manipulate, and prevent customers from acting.<\/strong> Dark patterns include:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><a href=\"https:\/\/www.nytimes.com\/2023\/07\/07\/your-money\/cancelling-subscriptions-ftc.html#:~:text=The%20F.T.C.%20is%20also%20proposing,the%20same%20number%20of%20steps\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>\u201cNegative option\u201d plans<\/strong><\/a><strong>, <\/strong>which automatically enroll customers or renew services for customers who don\u2019t proactively opt out of them.<\/li><li><strong>Hurdles to terminating services<\/strong>\u2014like requiring customers to click through multiple screens before they can end a service and dimming the \u201ccancel\u201d button.\u00a0\u00a0<\/li><\/ul>\n\n\n\n<p><strong>Companies also use strong-arm tactics <\/strong>to get consumers to continue to pay for subscriptions they don\u2019t want. For example:&nbsp;&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Cable and phone companies often <\/strong><a href=\"https:\/\/www.npr.org\/2023\/03\/23\/1165527249\/ftc-rule-charges-cancel-online-subscriptions\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>require customers to talk to a customer service representative to cancel their subscriptions<\/strong><\/a>. Representatives\u2019 primary function during these calls is to pressure customers <em>not<\/em> to terminate services.<\/li><li><strong>Gyms often require members to have an in-person conversation with a rep, or send a request via certified or notarized mail<\/strong> if they want to end their memberships.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-click-to-cancel-regulation\"><strong>\u201cClick to Cancel\u201d Regulation<\/strong><\/h3>\n\n\n\n<p>In March, the Federal Trade Commission (FTC) announced efforts to crack down on subscription service companies\u2019 aggressive and deceptive sales tactics with a new <a href=\"https:\/\/www.ftc.gov\/news-events\/news\/press-releases\/2023\/03\/federal-trade-commission-proposes-rule-provision-making-it-easier-consumers-click-cancel-recurring\" target=\"_blank\" rel=\"noreferrer noopener\">&#8220;Click to Cancel&#8221;<\/a> rule.<strong> The proposed regulation would make it easier for customers:\u00a0<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>To understand exactly what they\u2019re signing up for<\/strong> before enrolling in a new subscription service.<\/li><li><strong>&nbsp;Terminate and get refunds <\/strong>for subscriptions and memberships they don\u2019t want.&nbsp;<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-what-would-click-to-cancel-do\"><strong>What Would \u201cClick to Cancel\u201d Do?<\/strong><\/h3>\n\n\n\n<p><strong>Click to Cancel would ban companies from employing dark patterns<\/strong> and require them to:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Make canceling a subscription <\/strong><a href=\"https:\/\/www.npr.org\/2023\/03\/23\/1165527249\/ftc-rule-charges-cancel-online-subscriptions\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>as easy as it is to sign up for one<\/strong><\/a><strong>. <\/strong><\/li><li><strong>Ensure that consumers are aware of key terms before billing them for services<\/strong>.<\/li><li><strong>Get customers\u2019 permission to offer perks or discounts<\/strong> aimed at getting them to continue paying for their subscriptions.\u00a0\u00a0<\/li><\/ul>\n\n\n\n<p>If implemented, the new rule could<strong> <\/strong><a href=\"https:\/\/www.ftc.gov\/news-events\/news\/press-releases\/2023\/03\/federal-trade-commission-proposes-rule-provision-making-it-easier-consumers-click-cancel-recurring\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>save customers time and money<\/strong><\/a><strong> and penalize companies for deception by enabling the FTC to:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><a href=\"https:\/\/www.npr.org\/2023\/03\/23\/1165527249\/ftc-rule-charges-cancel-online-subscriptions\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>Claw back funds for consumers<\/strong><\/a> victimized by companies\u2019 manipulation tactics.<\/li><li><strong>Enforce civil penalties<\/strong> of up to $50,000 per violation per day for businesses that break the new rules.<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-looking-ahead\"><strong>Looking Ahead<\/strong><\/h3>\n\n\n\n<p>The FTC has not announced when it will finalize Click to Cancel. Until the rule goes into effect, experts recommend taking the following steps to protect yourself from deceptive and strong-arm practices:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Before you enroll in a new subscription service:<\/strong> Research (outside of the business\u2019s website) <a href=\"https:\/\/www.nytimes.com\/2023\/07\/07\/your-money\/cancelling-subscriptions-ftc.html#:~:text=The%20F.T.C.%20is%20also%20proposing,the%20same%20number%20of%20steps\" target=\"_blank\" rel=\"noreferrer noopener\">the company\u2019s cancellation policy and related complaints<\/a>.\u00a0<\/li><li><strong>When you enroll in free trials:<\/strong> Set phone reminders to alert you when it\u2019s time to cancel.<\/li><li><strong>When purchasing subscriptions:<\/strong> Look for pre-checked boxes and uncheck things you don\u2019t want.\u00a0<\/li><li><strong>Every 90 days: <\/strong>Examine recurring charges and cancel anything you\u2019re not using.\u00a0<\/li><\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Do you dread canceling subscriptions because the process can be so convoluted?
