The controversial, pandemic-era public health order, established by former president Donald Trump and extended by President Joe Biden, <a href=\"https:\/\/www.marketplace.org\/2023\/05\/11\/end-of-title-42-migrants-us-border-economy\/\" target=\"_blank\" rel=\"noreferrer noopener\">barred migrants from claiming asylum<\/a> at the US-Mexico border and allowed US agents to rapidly expel them from the country, claiming risks to public health.\u00a0<\/p>\n\n\n\n<p>Some object to letting the law lapse, saying that without it, our borders will be overrun with immigrants seeking asylum. But others say this is unlikely\u2014Title 42 wasn\u2019t very effective at stopping immigration in the first place, and now that it\u2019s gone, the US can implement more effective policies.&nbsp;<\/p>\n\n\n\n<p>Economists and business leaders take a different tack: They say we shouldn\u2019t be so focused on keeping immigrants out in the first place, and that attention given to the efficacy of Title 42 distracts from the larger issue of how to better integrate migrants into the labor force. They argue that immigrants play a crucial role in keeping the American economy growing, and a better use of our government\u2019s time would be to figure out how to allow willing workers to legally work.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-with-title-42-gone-will-immigration-rates-soar\"><strong>With Title 42 Gone, Will Immigration Rates Soar?&nbsp;<\/strong><\/h3>\n\n\n\n<p>Though many are concerned that immigration will surge now that Title 42 has ended, others note that the law <a href=\"https:\/\/www.wola.org\/analysis\/end-title-42\/\" target=\"_blank\" rel=\"noreferrer noopener\">didn\u2019t have much of an effect<\/a> on immigration rates anyway: Border-crossing attempts were already at a near-record high\u2014in part because the US economy has been strong, thus tempting people in search of work, and in part because Title 42 established no penalties for unauthorized crossings, so people who were deported often turned around and <a href=\"https:\/\/nypost.com\/article\/what-is-title-42-expulsion-immigration-policy\/\" target=\"_blank\" rel=\"noreferrer noopener\">immediately tried again<\/a>.\u00a0<\/p>\n\n\n\n<p>Further, the expiration of Title 42 <a href=\"https:\/\/www.wsj.com\/articles\/immigrants-share-of-the-u-s-labor-force-grows-to-a-new-high-67805c45\" target=\"_blank\" rel=\"noreferrer noopener\">doesn\u2019t necessarily mean easier entry into the country<\/a>:\u00a0<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>The US will now revert to following Title 8, the longer-standing law governing immigration that carries harsher penalties for repeated unauthorized attempts at entry\u2014up to and including felony charges.\u00a0<\/li><li>The government is also increasing eligibility standards that asylum seekers must meet in order to qualify.\u00a0<\/li><\/ul>\n\n\n\n<p>US officials say it\u2019s <a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2023\/05\/16\/update-on-border-title-42-ends\/70220537007\/\" target=\"_blank\" rel=\"noreferrer noopener\">too early to tell<\/a> how migration patterns might change, but so far, <a href=\"https:\/\/www.nbcnews.com\/politics\/immigration\/title-42-border-surge-already-begun-rcna82980\" target=\"_blank\" rel=\"noreferrer noopener\">predictions of a surge<\/a> haven\u2019t come to pass. In fact, in the days following the law\u2019s expiration, the number of migrants processed by border agents <a href=\"https:\/\/www.fox4news.com\/news\/border-migrant-encounters-have-dropped-by-half-since-title-42-ended-federal-official-says\" target=\"_blank\" rel=\"noreferrer noopener\">dropped by half<\/a>\u2014from 10,000 a day to 5,000. Some experts suggest that migrants might indeed be <a href=\"https:\/\/www.nbcnews.com\/politics\/immigration\/post-title-42-migrants-rethinking-border-crossing-rcna85323\" target=\"_blank\" rel=\"noreferrer noopener\">reconsidering strategies to enter the US<\/a> due to Title 8\u2019s penalties.\u00a0\u00a0<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-immigration-and-the-us-economy\"><strong>Immigration and the US Economy<\/strong><\/h3>\n\n\n\n<p>Many business leaders are hoping that the demise of Title 42 will lead to <strong>improved immigration policies and ultimately, <\/strong><a href=\"https:\/\/www.cbsnews.com\/news\/title-42-here-are-the-benefits-migrants-can-and-cannot-qualify-for\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>more legal immigrants<\/strong><\/a><strong>, <\/strong>in hopes of resolving the ongoing labor shortage that began during the pandemic and continues to this day. Tighter immigration policies, which coincided with increased retirement rates, have resulted in significantly higher rates of unfilled jobs\u2014<a href=\"https:\/\/econofact.org\/labor-shortages-and-the-immigration-shortfall\" target=\"_blank\" rel=\"noreferrer noopener\">particularly in sectors more dependent on foreign labor<\/a>, such as hospitality and construction\u2014making it difficult for many organizations to operate at full capacity.\u00a0\u00a0<\/p>\n\n\n\n<p>These experts note that immigrants <strong>fill a needed demand for workers<\/strong> as the <a href=\"https:\/\/www.wsj.com\/articles\/immigrants-share-of-the-u-s-labor-force-grows-to-a-new-high-67805c45\" target=\"_blank\" rel=\"noreferrer noopener\">percentage of native-born workers continues to shrink<\/a> not only because of increased retirements but also because of a smaller working-age population, largely due to Covid deaths, illness, or caretaking demands. Further, in the long run, birth rates in the US are continually decreasing, portending even <a href=\"https:\/\/www.prb.org\/articles\/want-another-perspective-on-the-u-s-labor-shortage-talk-to-a-demographer\/\" target=\"_blank\" rel=\"noreferrer noopener\">smaller working populations in the future<\/a>.\u00a0<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>In 2022, foreign-born workers made up a record percentage of the labor force, at over 18%\u2014the highest level in decades.
